Driving Without Privileges is actually an area of law that has become more lenient, overall. Until recently, failure to pay a fine could result in license suspension. Plus, it was a misdemeanor to drive on a suspended license. In March 2018 the law was updated so that licenses would no longer be suspended for failure to pay a fine. Anyone who currently had their license suspended at that time had their privileges reinstated automatically. Plus, sentencing is now milder – a $150 fine for the first two instances.

However, you can get a misdemeanor charge in certain scenarios. A third conviction in a 5-year period is a misdemeanor. You can also get a misdemeanor if your DWP is coupled with DUI or reckless driving. If that describes you, you are vulnerable to jail time, a hefty fine, and other severe sentencing.
