Understanding Idaho’s Commercial Sexual Activity Charges
Idaho restructured its prostitution laws under Title 18, Chapter 56 of the Idaho Code, using the term “commercial sexual activity” to describe the full range of offenses. Knowing which charge applies to your situation is the first step toward understanding what you’re facing.
Providing Commercial Sexual Activity (Idaho Code §18-5613):
This statute covers engaging in, offering, or agreeing to engage in sexual contact for a fee, as well as loitering in public for the purpose of being hired for sexual contact. A first or second offense is a misdemeanor. A third or subsequent conviction, including prior prostitution-related convictions, elevates the charge to a felony.
Soliciting Commercial Sexual Activity (Idaho Code §18-5614):
This statute covers paying, offering to pay, or agreeing to pay another person for sexual contact, or arranging for a third person to engage in sexual contact for a fee. Under Idaho law as amended effective July 1, 2026, penalties depend on the defendant’s age. For persons aged 18–20, a first offense is a misdemeanor carrying a mandatory minimum of 5 days in jail, up to one year imprisonment, and a fine up to $2,000. A second or subsequent conviction becomes a felony. For persons 21 and older, solicitation is a felony from the first offense, carrying a mandatory minimum of six months in jail, up to three years imprisonment, and a fine up to $10,000.
