Penalties for Indecent Exposure in Idaho

Under Idaho Code 18-4116, a first indecent exposure offense is a misdemeanor. The stakes rise sharply from there. Under the 2025 amended statute, a third conviction within five years is a felony carrying up to five years in state prison. That escalation is reason enough to treat even a first charge with full seriousness.

One distinction many competing sources get wrong: a misdemeanor conviction for indecent exposure does not trigger mandatory sex offender registration under Idaho Code 18-8304. The statute expressly excludes misdemeanor indecent exposure from the registration requirement. A felony conviction does require registration. In Ada County, registration is administered by the Ada County Sheriff, and registered individuals must register within two working days of sentencing and re-register annually.

One more detail worth knowing: a withheld judgment still counts as a conviction for purposes of the repeat-offense felony threshold. That’s a counterintuitive result that can catch people off guard when a prior case felt resolved.
