What Idaho Law Defines as Indecent Exposure

Idaho Code 18-4116 defines indecent exposure as willfully and lewdly exposing specific body parts in a public place or anywhere another person present is offended. The statute covers exposure of genitals, developed female breasts (including the areola and nipple), medically or hormonally altered adult male breasts intended to appear female, artificial breasts intended to resemble female breasts, and the display of toys or products intended to resemble male or female genitals. It also applies to anyone who procures, counsels, or assists another person in committing the same acts.

Two words in that definition matter enormously for your defense: willfully and lewdly. This is the required mental state under the statute. Accidental or unintentional exposure doesn’t satisfy it. Charges can arise from situations the accused never intended as sexual, which is exactly where the facts of the specific incident become critical.

Idaho Code 18-4116(3) expressly exempts breastfeeding a child or expressing breast milk for feeding purposes from the scope of the statute.

Penalties for Indecent Exposure in Idaho

Under Idaho Code 18-4116, a first indecent exposure offense is a misdemeanor. The stakes rise sharply from there. Under the 2025 amended statute, a third conviction within five years is a felony carrying up to five years in state prison. That escalation is reason enough to treat even a first charge with full seriousness.

One distinction many competing sources get wrong: a misdemeanor conviction for indecent exposure does not trigger mandatory sex offender registration under Idaho Code 18-8304. The statute expressly excludes misdemeanor indecent exposure from the registration requirement. A felony conviction does require registration. In Ada County, registration is administered by the Ada County Sheriff, and registered individuals must register within two working days of sentencing and re-register annually.

One more detail worth knowing: a withheld judgment still counts as a conviction for purposes of the repeat-offense felony threshold. That’s a counterintuitive result that can catch people off guard when a prior case felt resolved.

Even at the misdemeanor level, a conviction can affect employment, housing applications, and professional licensing in ways that follow you well beyond the courtroom.
